THE MAKERBARN RULES AND POLICIES

Note: These rules and policies are a work in progress.

Rule and Policy changes

These rules and policies are subject to change. Changes will become effective immediately upon successful vote of adoption by the Executive Committee or by the membership at a membership meeting. A summarized version of these rules will be posted in the space, with a link to the full rules.

Code of conduct
  1. All members and their guests must follow the Code of Conduct.
  2. Safety is important, if you are unsure of how to safely do something, don’t do it.
  3. Executive Committee Members and the President may ban anyone who violates the Code of Conduct from the premises or online systems. Bans may be reversed upon agreement by 2 or more members of the Executive Committee.
  4. Don’t merely respect each other; be excellent to each other.
  5. A. We are all here to make things and learn. Collaboration is important.
    B. When you break something, own up to it. If you have any doubt about fixing it, ask for help. Don’t make someone feel bad for breaking something, help them understand what went wrong.[1]
    C. Clean, Maintain, Organize, Improve. Always leave the space better than you found it.[2]
    D. Don’t be afraid to ask questions. Answer them kindly; eventually you’ll have to ask for help too.
    E. Tools/resources must stay on the premises so that other members may use them.[3]

  6. Everyone must sign a liability waiver.
  7. Sleeping is not cool, but naps are ok. We are not a hotel.[4]
  8. All members are expected to maintain a safe and clean environment at all times.
  9. Consuming alcohol and smoking – cigarettes, cigars, vaporizers (also known as electronic cigarettes) – is not allowed anywhere inside the MB property.
  10. No pets allowed in the building.
  11. Don’t catch fire, set others on fire, or set anything on fire which has not been designated or designed to be on fire.
  12. It is the responsibility of each member to help enforce the Code of Conduct. If someone is violating the Code of Conduct politely explain to them why their behavior is not acceptable. Egregious violations should be reported to a member of the Executive Committee or the President.
Guests
  1. Guests cannot inhabit the MakerBarn without another keyed Member present.
  2. All guests must sign a liability waiver.
  3. Guests are encouraged to become Members.
  4. Members are responsible for their Guests and their actions.
Minors
  1. Minors 15 and under must be accompanied closely by Parent or Legal Guardian at all times and are not allowed to have an access card.
  2. A. Accompanied closely means visual range generally, and immediate reach when near dangerous tools.
  3. Parents/Legal Guardians are responsible for their children and their actions. There is absolutely no horse play allowed in the shop areas.
  4. Minors under the age of 18 must have their liability form signed by a Parent or Legal Guardian.
  5. For Individual Memberships, access cards will only be issued to members 18 years or older.
  6. For Family Memberships, a family member 16 or 17 years old can be issued an access card, but machine certification is required for both a guardian and the 16 or 17 year old in order to be signed off on each particular piece of equipment.
Formal complaints

The formal complaint process exists for members to request a discussion be held by the Executive Committee regarding specific actions of another member. Members are expected to discuss their complaints in a calm and polite manner. Mediation is available to resolve issues without the need of a formal complaint.

  1. Formal complaints against another member must be submitted, in writing, to the Executive Committee or to any member of the Executive Committee.[5] The complaint must have two parts outlined at minimum, a “Complaint” part and a “Recommended Solution” part
  2. The Executive Committee will decide to either hold a special meeting regarding this matter, or will consider it at the next meeting in its cycle.
  3. The Executive Committee is not required to act in accordance to the grievance or complainant’s “Recommended Solution” part and may devise its own remediation.
  4. Complaints will be added to the agenda of the meeting, without identifying information.
  5. Minutes for the meeting will not be scrubbed of identifying information.
Non-Discrimination policy

The MakerBarn does not promote or discriminate against any person, population group, or organization with regard to categories protected by applicable United States law. These include, but are not limited to race, color, religion, sex, gender expression, physical appearance, language, education background, national origin, age, disability, and veteran status.

Membership dues

FAMILY YEARLY MEMBERSHIP $698/year This rate is 3% off the monthly rate of $60. Eligible for voting rights after 3 months, see Voting Rights.
Voting rights
  1. All members start off as Supporting Members, with no voting rights.[6]
  2. A Supporting Member may submit an application to become a Regular Member only after 90 days of membership. The application will be in the form of an email to [email protected].
  3. A member’s application to change from Supporting Member to Regular Member will be approved automatically at the next meeting.
Storage
  1. The MakerBarn is not a storage facility. Projects and materials that do not follow these rules, will be considered donations.
  2. Projects (and materials for them) can only be stored in designated Project Storage Areas.[7]
  3. Projects (and materials for them) stored in the Project Storage Areas must follow the rules and policies created by the Logistics Committee which may be changed at any time.
  4. A project may be stored elsewhere with the approval of a member of the Executive Committee or by a vote of the membership.
  5. Firearms, gunpowder, primers, and assembled ammunition cannot be stored at the MakerBarn.
Storage in shop areas[8]
  1. Anything in a committee area is available for use by all members unless documented/labeled as training required.
  2. Items that require training are secured by MACS, but a path to obtain use of said tool should be documented.
  3. If a person must be contacted to use a tool, 2 or more points of contact must be listed on/around tool.
  4. Storage of materials is not permitted in shop areas unless there is a defined/documented area.
  5. For items to be considered on display and not storage, items have to be in a designated area.
  6. Anything that is a personal item in a committee area must have gone through the Loaning of Tools & Equipment to the MakerBarn
  7. If training is required and a member requests training for the loaned tool, the tool owner has one month to offer the training. If one month passes without the requested training, the personal item on loan is subject to removal within 30 days.
Events
  1. Events must be on the official calendar to be considered scheduled.
  2. Scheduling of events is done on a first-come basis, as determined by the calendar management system.
  3. Scheduled events should uphold our Mission Statement
  4. Scheduled events take priority over unscheduled events.
  5. Scheduling conflicts should be worked out peaceably by the affected parties. Disputes will be arbitrated by members of the Executive Committee, or by the Executive Committee as a whole.
  6. All events must be sponsored by a current member, who must be present during the event.
  7. Donations are encouraged but not required to hold events.
  8. Guest access to the facility will be limited as required by the event.
  9. Terms and Conditions for events can be dictated and modified by the Executive Committee.
Organizational meetings
  1. Executive Committee meetings will be held prior to the 2nd Thursday Meeting on an as-needed basis
  2. Executive Committee meetings will be posted on the MakerBarn Events calendar. For purchases over $200, the request must include a description of how this spending furthers the organization’s Tax Exempt purpose.
  3. Regular membership meetings will be held every 2nd Thursday at 7pm, at the MakerBarn.
  4. An informal Open House and Q&A will be held every 4th Thursday at 7pm, at the MakerBarn.
  5. The President shall preside over the membership meetings.
  6. If the President is unavailable, the members of the Executive Committee who are present will choose, via consensus, a temporary meeting chair.
  7. If no member of the Executive Committee is present or consensus cannot be reached, the committee chairpersons present will vote to determine the temporary meeting chair.
Committees

Committees are voluntary groups, formed by members in order to achieve certain goals.

RULES
  1. Committees must be approved by the Executive Committee.
  2. Committee chairpersons are appointed by the Executive Committee.
  3. At least 3 members are required to form a committee.
  4. The Committee chairperson will be responsible for maintaining the list of committee members and providing reports on the status and activities of the committee.
  5. There is no limit to the number of committees a member can serve on.
  6. Each committee will need to maintain a page on the wiki with at least the following information:
  7. A. The name of the committee chair B. A list of all active members C. A brief statement listing the goals or tasks assigned to the committee.
  8. By default binding committee decisions can be made by the chairperson or by majority vote of the committee members. Governance model can be changed by majority vote of the committee members.
  9. Committee meetings must be posted on the calendar and announced on the forums.
  10. Committees can appoint advisory members, who only have communications access to MakerBarn resources, pending Executive Committee approval.
Commercial use

The MakerBarn is based on open source ideals and thus encourages its membership to embrace those ideals as well, however members reserve the rights to all of their creations.

Loaning of tools and equipment to The MakerBarn

Members can generously provide tools or equipment for use in the space, either by donating them outright or by loaning them.

When equipment is loaned, the following conditions apply:

  1. All loaned equipment must be marked or labeled with the owner’s name
  2. The owner must contact the Operations and Facilities Committee so that they can record the following information:
  3. A. Name of owner B. Equipment being loaned C. Serial number if available D. Terms or conditions of the loan
  4. Equipment is loaned subject to the understanding that it is preferable for the MakerBarn to own their equipment, rather than borrow it. The MakerBarn may seek to buy equipment in order to replace loaned items, which are then returned.
  5. Loaned items may be returned at any time, by request of the owner or as determined by the Operations and Facilities Committee.
  6. The MakerBarn is NOT responsible for maintenance of loaned equipment, but may maintain it as determined by the Operations and Facilities Committee.
  7. The MakerBarn is NOT responsible for the damage, theft, or loss of equipment. However, efforts will be made to provide reasonably secure storage.
Donations
  1. Donations of usable items must be approved by the committee in charge of the location in which the item will be stored/used.
  2. A “freebie shelf” is available for items that are free to use/take for all members. The shelf will be periodically cleared by the Ops committee.
  3. Donations for the “freebie shelf” will be accepted so long as there is available free space in the designated area, and as long as it does not conflict with rule #5.
  4. Donations for the “freebie shelf” that do not fit cannot be left in the space unless approved by the Ops committee
  5. The following items will not be accepted for donation:
  6. A. CRT monitors B. Housepaint
  7. Donations to a project are only spent on that project and are spent prior to any MakerBarn allocated money to the same project
  8. A. If the project is deemed unsuccessful all remaining funds will be returned to the source. B. Allocated money will be returned to the source fund, if more overages remain the money will be returned to the contributor in proportion to their donation. C. If the project is deemed successful, accomplishing the stated goal, any unspent allocations will be returned to the committee fund in charge of the project, unspent donations will be returned the contributors according to the proportion of the donation.

Finances
  1. No authorization or allocation can be made in excess of the moneys available in the General Fund.
  2. Refunds for membership dues paid within the last 30 days can be authorized ONLY at the discretion of the Treasurer or President.
  3. The MakerBarn must receive a written invoice or receipt prior to payment for any services or goods. This only applies to vendors who regularly provide a written invoice (or receipt) to their customers. If a best effort is not made to provide the treasurer with a written invoice (or receipt) from the respective vendor:
  4. A. The MakerBarn will not provide payment for the respective goods or services.
    B. If the transaction was already purchased with funds belonging to the MakerBarn, the amount of the respective transaction must be refunded to the MakerBarn.

  5. All property purchases equal to or greater than $300 and having a useful life of one year or more are to be capitalized.
  6. All individual items purchased for less than $300 and/or having a useful life of less than one year are to be expensed.
  7. Only current procurement officers are allowed to have an active MakerBarn debit card.
  8. A. After changes in procurement officers, it is the responsibility of the Treasurer to ensure the credit card company’s records are updated.

  9. Only the current Treasurer and Directors are allowed to be authorized signers on the MakerBarn bank accounts.
  10. A. After a change in Treasurer, it is the responsibility of the Directors to ensure the bank’s records are updated.
Notes

These notes are not officially part of the Rules or Bylaws and are only meant to provide additional information or an interpretation of the Rules and/or Bylaws.

  1. You will not be asked to replace/repair equipment due to honest mistakes, we just want to know why something broke so we can prevent it in the future.
  2. This includes taking out the trash, wiping down tables, vacuuming/sweeping floors, returning tools to the proper place, etc.
  3. Removing tools/resources from the space without authorization from an Officer or member of the Executive Committee is theft.
  4. A nap is a short period of sleep, typically taken during daylight hours as an adjunct to the usual nocturnal sleep period. Naps are most often taken as a response to drowsiness during waking hours. If you are “napping” at the space instead of sleeping at home, you are violating the rule. Please drive responsibly, if you are too tired to drive use Uber/Lyft or call a cab.

Rules & Policies

I acknowledge access to The MakerBarn Rules & Policies (on The MakerBarn website) and agree to review and become familiar with it. I will take responsibility for my child's behavior while on campus, and I will counsel my child regarding MakerBarn Rules and Policies.

Model Release

I hereby assign and grant to The MakerBarn the right and permission to use and publish photographs, film, video tapes, electronic representations and/or recordings made during MakerBarn classes and events, and I hereby release MakerBarn and any of the staff from any and all liability from such use and publication. I further authorize the reproduction, sale, copyright, exhibit, broadcast, & electronic storage of recordings without limitation at the discretion of the MakerBarn staff and I specifically waive any right to any compensation I may have for any of the foregoing.

Please Note: Photos will be taken during MakerBarn events and activities throughout the year. If this is a concern, you are responsible to monitor photography of yourself or child(ren).

Directory

The MakerBarn Directory includes all members enrolled. At a minimum, the directory will include

the members' names, phone number, and email address. The Directory is available on our membership website and you have the options to control the information shared and displayed to other members . The MakerBarn respects your privacy and will not at any time sell or give out your personal information to interested third parties.

Your email address(es) will be added to our monthly newsletter list. You may unsubscribe from that list at any time.

Liability Waiver

This agreement is between you and The MakerBarn, 28030 FM2978 Suite 204, Magnolia TX 77354 By signing this agreement, I acknowledge that The MakerBarn is a dangerous place and I agree to hold harmless The MakerBarn, its members, its officers, and its directors.

I also understand that I am personally responsible for my own and my minor's safety and actions and will instruct and ensure that I and they follow all safety instructions and signage while at The MakerBarn.

I hereby waive for myself and minor children all rights of recovery, claim, action, or cause of action against The MakerBarn for any injury or damage that may occur, regardless of cause or origin, including negligence.

I affirm that I am at least 17 years of age, and mentally competent to sign this liability waiver.
